1. Acceptance of Terms

By visiting Station 385 Car Wash (“we,” “us,” “our”), purchasing a single wash, using free-vacuum areas, enrolling in our Unlimited Wash Club, or using our website/app, you agree to these Terms & Conditions and any posted policies (Privacy, Safety, Promotions). If you do not agree, do not use our services.

2. Hours, Closures & Availability

Posted hours: Mon–Fri 8 AM – 7 PM • Sat 8 AM – 6 PM • Sun 9 AM – 5 PM

All services are provided on an availability basis. We may modify operating hours, limit services, or temporarily close without notice due to weather, maintenance, equipment issues, holidays, or operational requirements.

We reserve the right to modify, suspend, or discontinue any service or feature at any time.

3. Safety & Vehicle Requirements (Tunnel Wash)

You are responsible for ensuring your vehicle is suitable for an automated tunnel wash. By entering, you confirm:

  • No loose exterior items or accessories (antennas, light bars, magnets, flags), no bike racks or hitch cargo, truck beds are empty and closed, mirrors secure, fuel caps closed. Vehicle must be within posted height, width, and tire specifications.
  • Transmission must be in neutral as instructed, wheels straight, and driver assistance features (auto-hold, parking assist, automatic wipers) disabled. Follow all attendant instructions and signage at all times.
  • Failure to comply may result in service refusal for safety reasons.
  • We reserve the right to refuse service where vehicle condition, configuration, or safety concerns may pose a risk to equipment, staff, or operations.

4. Membership Services

Memberships are offered on a recurring 30-day billing cycle. By enrolling, you authorize automatic renewal and billing at the applicable monthly rate until cancelled.

There is no long-term commitment required. Members may cancel at any time through the designated cancellation process. Cancellation will remain active at the end of the current billing cycle.

Membership plans may be upgraded or downgraded at any time, with changes applied in the next billing cycle.

Memberships may be temporarily suspended upon request if a member is out of town or out of the country, in which case billing will be paused for the approved suspension period.

In the event of payment failure, access to membership services may be suspended until outstanding balances are resolved. Repeated payment failures or misuse of membership privileges may result in termination of membership access.

Memberships are intended for personal vehicle use only and are subject to verification and compliance with Station 385 policies. We reserve the right to terminate memberships in cases of suspected fraud, abuse, or policy violations.

5. Damage Policy

We are not responsible for: pre-existing damage; non-factory, loose, or fragile parts; antennas/brackets; mirrors/emblems; wiper blades; wheel caps; aftermarket wraps/paint/PPF/ceramic coatings; previously repaired or oxidized paint; pre-existing windshield cracks or chips; open truck beds or loose interiors; corrosion or water leaks.

Any incident must be reported before leaving the property. Inspection and resolution may require review of site logs/cameras.

Where we are at fault, remedies are limited to the reasonable cost of repair as determined by us and our repair partners. Services are otherwise provided as is and as available.

6. Free Vacuums & Property Conduct

Free vacuum stations are available for Station 385 members and single wash customers. They may be used before or after your wash.

Vacuums are intended for light interior cleaning only. Commercial detailing, extended occupancy, or misuse of the area is not permitted.

A Station 385 Car Wash associate is always onsite during scheduled business hours to assist customers, manage operations, and ensure a safe, efficient, and high-quality customer experience.

We reserve the right to limit usage, refuse access, or remove individuals from the premises where necessary for safety, operational, or conduct-related reasons.

7. Promotions, Coupons & Launch Offers

Promotions (including free-wash offers) are limited-time, subject to change, and have no cash value unless explicitly stated. Offers cannot be combined unless specified. One use per person or vehicle may apply. Commercial or fleet vehicles may be excluded.

We reserve the right to verify eligibility and refuse or revoke promotional use in cases of misuse, fraud, or system abuse.

8. Privacy, Cameras & Communications

Station 385 Car Wash is committed to protecting personal information and operates in accordance with applicable privacy laws and best practices, including the principles of PIPEDA (accountability, purpose, consent, limiting collection, safeguards, access, and openness).

We may collect and process personal data including, but not limited to, contact information, payment tokens, License Plate Recognition (LPR) identifiers, vehicle plate numbers, and visit and transaction logs.

This information is used strictly for:

  • Operating memberships
  • Processing payments
  • Preventing fraud
  • Managing access control
  • Improving services and operational efficiency

We utilize License Plate Recognition (LPR) technology at entry points to identify enrolled member vehicles. We may also operate CCTV systems on-site for safety, operational monitoring, and incident review purposes, with appropriate safeguards.

We may send email and SMS communications related to service updates, transactional notices, and marketing communications where consent has been provided. All marketing communications include clear identification and an unsubscribe option in compliance with CASL. Consent may be withdrawn at any time.

Service and transactional communications may still be required for active memberships or purchases.

Where LPR systems are used, we provide notice regarding their purpose, operation, and data handling practices. Customers may request access to or correction of their personal information in accordance with applicable law.

9. Website/App & Third-Party Systems

Access to digital features may rely on third-party platforms (including payment processors, subscription systems, and operational software). These providers may have separate terms and privacy policies.

We are not responsible for downtime, service interruptions, errors, or data loss caused by third-party systems, except where required by applicable law.

10. Liability Limit

To the fullest extent permitted by Ontario law:

  • We are not liable for indirect, incidental, special, or consequential damages, including loss of use, inconvenience, or business interruption.
  • Our total liability for any claim shall not exceed the amount paid for the service in question within the preceding 30 days.
  • Nothing in these Terms limits liability where such limitation is not permitted by law.

11. Changes to Terms

We may update these Terms at any time. Material changes affecting memberships, billing, or core service terms will be communicated in advance where required, and customers will be given the opportunity to cancel before such changes take effect.

12. Governing Law

These Terms & Conditions are governed by the laws of the Province of Ontario and the laws of Canada applicable therein. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ontario.
